Noxious Weeds

To manage and control Council’s noxious weeds operations and to establish strategies and statements to control noxious weeds in accordance with the Noxious Weeds Act 1993 within the Shire.

OBLIGATIONS OF PRIVATE LANDHOLDERSThe action required to be taken under this Act to control a noxious weed for which a particular control category is specified is the action set out below in relation to that control category;

  • For a Control Class 1 State Prohibited Weeds

The plant must be eradicated from the land and the land must be kept free of the plant. C1 weeds are Notifiable Weeds and the council needs to be notified within three days of detection.

·    For a Control Class 2 Regional Prohibited Weeds

The plant must be eradicated from the land and the land must be kept free of the plant. C2 weeds are Notifiable Weeds and the council needs to be notified within three days of detection.

·     For a Control Class 3 Regionally Controlled Weeds

The plant must be fully and continuously suppressed and destroyed to reduce the area and impact.

·          For a Control Class 4 Locally Controlled Weeds

The growth and spread of the plant must be controlled according to the management plan to minimize the negative impact of the weeds on the economy, community or environment.

·          For a Control Class 5 Restricted Plants

To prevent the introduction of these plants into NSW and the spread of these plants within and to another jurisdiction, by their sale or the sale of their seeds or movement within the state. C5 weeds are Notifiable Weeds and the council needs to be notified within three days of detection.

Property Inspection Procedure
The following guidelines have been agreed to by Council.

1. Inspections - Notices - Classification.

1.1 Council's method of implementing noxious weeds control will be, after the first inspection, advising in writing and/or verbally, the presence of specific weeds on the property and a reasonable time for the agreed control to be undertaken.

1.2 The second inspection will be followed by a notice under Section 18 of the Noxious Weeds Act, 1993 and will be served if the agreed control measures have not been undertaken.

1.3 Failure to comply with the Section will result in Council instituting SEINS or court proceedings for non-compliance under Section 12 and/or Section 19, Noxious Weeds Act 1993.

1.4 Failure to comply with the Section 18 notice may also result in the issue of a notice under Section 20 of the Noxious Weeds Act , 1993 after which Council, may enter onto the property and carry out the work, at the landowners expense.

Eastern Riverina Noxious Weeds Advisory Group (ERNWAG) and Western Riverina Noxious Weeds Advisory Group (WRNWAG) are the leading committees for weed management in the Riverina region including the catchments of the Murray, Murrumbidgee, Lower Murray Darling and Lachlan.

The groups comprise all key stakeholders in weed management from Tumut in the east to Wentworth/ SA border in the west and Carrathool in the north to the Murray River in the south. +
Macquarie Valley Weeds Advisory Committee have recently developed a website to increase awareness of weeds issues in western NSW.  Cootamudnra Shire Council is a member of this committee. Visit www.westernweeds.org for further information
